Gallery of questionable collection letters

Some collection agencies, collection lawyers, and creditors may be sending consumers written collection notices which may be described as questionable. These letters may be misleading, contain false or inaccurate statements, or in some cases may be illegal.

Letter to Ontario resident that arguably violates subsection 24(a) of Regulation 74 of the Ontario Collection Agencies Act for making false or misleading statements

Mark Silverthorn sent a letter dated June 6, 2009, to Brian Pitkin, the Ontario Registrar of Collection Agencies, complaining that the above-noted collection letter dated May 12, 2009, from Unik Collectrite Inc. written to one of his clients violates subsection 24(a) of Regulation 74 of the Ontario Collection Agencies Act for making false or misleading statements. This collection letter written by Unik Collectrite Inc. suggests that the consumer will be garnisheed if the consumer does not pay their account within three days, a statement that is arguably false or, at the very least, is misleading.

Brian Pitkin responded to this complaint letter in a letter dated June 18, 2009. Set out below is Brian Pitkin's response to my complaint letter dated June 6, 2009.

Dear Mr. Anthony:

Re: Unik-Collectrite Inc. - Garnishment letter

Thank you for your letter of June 6, 2009.

I reviewed the material that you forward and agree with you that the letter is misleading. Consequently I have written to Unik-Collectrite Inc. instructing that the letter is not to be used in instances where judgment has not been obtained. I have also asked that the letter be amended to indicate that judgment has been obtained if it is to continue in use.
